All private sector employers with 100 or more employees, and federal contractors with 50 or more employees, meeting certain criteria, must submit an Equal Employment Opportunity Commission (EEOC) 2021 EEO-1 Component 1 report by May 17.
Employers working with a Professional Employer Organization (PEO) will be able to extend the filing deadline to June 21.
The United States Equal Employment Opportunity Commission (EEOC) is a federal agency established via the Civil Rights Act of 1964. It was created to administer and enforce civil rights laws designed to protect against workplace discrimination. The EEO-1 Component 1 report is a mandatory annual data collection of race/ethnicity, sex, and job categories required under section 709(c) of Title VII of the Civil Rights Act. It must be submitted to both the EEOC and U.S. Department of Labor every year.
Purpose of the EEO-1 Report
Authorized federal agencies will share the statistical data gathered from employers to gain a broader understanding about gender and race/ethnicity in workplaces across the country. Although this data is confidential, aggregated data is shared to avoid duplicate collection, and is made available to the public.
Additionally, and on different deadline dates than those for the upcoming EEO-1 report, there is an EEO-3 report required for local union information, an EEO-4 report mandatory for local and state governments, and an EEO-5 report that must be submitted by elementary and secondary school staff.
It’s not too late for employers to start the process for these mandatory reports. The 2021 EEO-1 Component 1 data collection is tentatively scheduled to open on Tuesday, April 12.
